What Is in the Package

Key Provisions Explained

Chance vs. Skill Architecture

The single most important decision in any promotion is whether winners are selected by chance (sweepstakes) or by merit against disclosed criteria (skill contest). This distinction determines your entire regulatory posture — registration requirements, bonding obligations, consideration rules, and disclosure standards all flow from it. The template forces you to choose one architecture and delete the other, preventing the ambiguous hybrid structures that create the most enforcement risk.

Free Alternative Method of Entry

For sweepstakes, the “no purchase necessary” requirement is not optional decoration — it is the legal barrier between a lawful promotion and a prohibited lottery. The package includes a structured AMOE provision that requires equal dignity: the free entry path must be available during substantially the same period, receive substantially equal treatment, and yield the same number and quality of entries as the primary method. A nominal or impractical AMOE is worse than none because it creates a false sense of compliance.

State Registration and Bonding Gates

Florida and New York both impose registration and bonding requirements for promotions above certain prize-value thresholds. Rhode Island has separate retail-establishment rules. The template includes a compliance-gate provision that conditions launch on completion of a jurisdiction-by-jurisdiction analysis — so you do not open entries in a state where you have not finished the required filings. Missed deadlines cannot reliably be cured after launch.

Prize Administration and Winner Verification

Potential winners are not winners until the sponsor verifies eligibility and compliance.
